The fifth paper began in the fall. Not mine. Not yet.Nora had been building the argument for two years in parallel with her law school coursework. She came to my office in September of her final year with a draft.Forty-two pages. The legislative argument for universality. The statutory framework that would extend the adequacy standard to every jurisdiction without waiting for case-by-case litigation. A model statute that states could adopt. A federal framework that Park could introduce.I read it in one sitting. It was not a student paper. It was work."You have been building this since you were fifteen," I said."Since I was nine," she said. "The library program taught me how to write policy. The internship with Park taught me how to write statute. I have been putting those two things together for three years.""The model statute," I said. "Section four. The enforcement mechanism.""Too much?" she said."Too little," I said. "The jurisdiction has to have a real consequence for non-

The four papers were collected and published as a single volume by a university press. The book was called The Access Architecture: Building Constitutional Protection for Legal Representation. The editors listed: Clara Reyes and Mia Carter. Clara's name first, as it had been on the second paper, because the constitutional argument was the foundation and the constitutional argument was Clara's.The book opened with a preface.I wrote the preface.I wrote about the first case. The family in Flatbush. The thing that had not been a legal theory or a constitutional argument or a Senate bill but a family that needed someone on their side.I wrote that everything in the four papers, all sixty-two and sixty-eight and sixty-four and sixty-eight pages of it, was the formal construction of a simple claim. That every person in a legal proceeding where the state was a party deserved representation that was real and adequate and honorable to the constitutional right it was supposed to uphold.I wro

The summer Oliver finished his second year of art school was the summer the family went to Italy together for the last time in the shape the family had been. Not the last time to Italy. The last time as this particular configuration. James was finishing his engineering degree in the spring. Nora had her work in Washington. Oliver had art school. Rosa was nine and spending her summers split between New York and Barcelona. The window when all of us could be in the same country for three weeks was closing. We went to Sicily. The same place as years before but with different people inside it now. The children were not children in the way they had been. James was twenty-one and had designed a bridge that was standing in the world. Nora was twenty-four and had argued her first case. Oliver was eighteen and had a gallery exhibition of his own work.We were five adults and two parents and one grandmother and two aunts and uncles and one nine-year-old who ran through the whole structure like s

The fifth paper's first section was complete in January.Josephine had written it. Clara had reviewed it. I had provided the structural critique. It argued that the access and adequacy standards, as developed in American constitutional law, were expressions of a democratic obligation that transcended jurisdictional lines. That a state that claimed to be democratic but failed to provide adequate legal representation to its citizens in proceedings where the state was a party was failing a requirement of democratic legitimacy. That the international human rights framework, read alongside the domestic constitutional development, supported this claim. It was the beginning of something. Not a finished argument. Not yet. The argument required the kind of sustained building that the first four papers had required, years of research and testing and revision before it was ready. But the foundation was being poured.I taught the first section in my seminar in February. The twelve students engage

The White House meeting was in the Roosevelt Room.Margaret Ellison was there. Two other members of the Counsel's office. And the President herself, who came in ten minutes into the meeting and who had read everything. She was direct about it."Justice Morales is retiring at the end of the term," she said. "She informed me last week. Her health makes continuing impractical.""I am sorry to hear that," I said."Her retirement creates a vacancy," the President said. "I would like to nominate someone who understands constitutional law at the level this moment requires."She was looking at me when she said it."The access framework cases," she said. "The four papers. The twenty years of building the constitutional argument from the ground level up. There is nobody in the country with that combination of academic depth and practical construction.""There are excellent jurists with strong access records," I said."There are jurists who applied the access standard after it was built," she sa
